5.1. We may use persistent cookies, clear GIFs and log file information, such as Internet Protocol Address and referring URLs, about activity on the website in order to enhance our understanding of website usage and to deal with problems. These remedies are in addition to any other remedies Bright On Capital may have at law or in equity.

14. JURISDICTION AND DISPUTE RESOLUTION

14.1. In the event of any dispute arising out of or in connection with your use of the Website, the parties shall attempt, promptly and in good faith, to resolve any such dispute.

14.2. In the event that the dispute cannot be resolved amicably within 30 (thirty) days), then either party may submit the dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

14.3. All matters relating to your access to or use of the Website, including all disputes, will be governed by the laws of the Republic of South Africa.

14.4. You agree to the jurisdiction of the South Gauteng High Court .

14.5. Any claim under these Terms and Conditions must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred.

14.6. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees.
